PUPPY STORE SUED FOR MISLEADING CUSTOMERS, SELLING SICK PUPPIES

(Pembroke Pines, FL) Two South Florida attorneys have filed a lawsuit on behalf of customers that bought puppies from Wizard of Claws Inc., alleging that the Pembroke Pines pet store defrauds customers by intentionally misrepresenting the origin of the puppies sold, and by selling puppies that suffer from a wide array of health problems, including contagious diseases and genetic disorders.

Although Wizard of Claws has told customers that their puppies were imported from "reputable" breeders in South America, according to the complaint filed yesterday Broward County Circuit Court, in reality the puppies were obtained from large scale commercial breeding facilities in Missouri, commonly known as a "puppy mills", where animal welfare concerns are wholly secondary to profits.

Plaintiff Shannah Diaz of Miami purchased a Maltese puppy, “Prince,” from Wizard of Claws on September 6, 2002 for $950.00. Prince suffered from a congenital bleeding disorder, and died from internal hemorrhaging when he was less than a year old. After Prince died, Diaz began to suspect that Prince had come from a puppy mill, and asked a Wizard of Claws. "They assured me that my puppy had come from a reputable private breeder " Diaz .said, "but I later discovered that my puppy had been shipped to Florida from a commercial breeder in Missouri. " Wizard of Claws refused to reimburse any of Diaz's vet bills.

According to the Humane Society of the United States, the documented problems of puppy mills include overbreeding, inbreeding, minimal veterinary care, poor quality of food and shelter, lack of socialization with humans, overcrowded cages, and the killing of unwanted animals. To the unsuspecting consumer, this often means buying a puppy facing an array of immediate veterinary problems or harboring genetically borne diseases that may not be detected until much later.

Wizard of Claws, which claims to specialize in "tiny, tea-cup size puppies" sells puppies from its Pembroke Pines store and over the Internet. Plaintiff Mary Ibarra of San Antonio, Texas ordered an English Bulldog from Wizard of Claws, and knew that something was very wrong with her new puppy moments after "Gracie" arrived from at the San Antonio International Airport. Gracie, who had received a clean bill of health from Wizard of Claws veterinarian of choice Dr. Jan Bellows, walked on her wrists and she kept falling down on her back legs. Gracie was soon diagnosed as suffering from severe hip dysplasia with early onset arthritis. Gracie’s hip sockets are so bad that they do not have a cup to hold the ball of the joint, and she needs at least two surgeries. If the surgeries are not successful Gracie will have to be euthanized. Wizard of Claws refuses to assist with the costs of the surgeries, or to even reimburse the $1200.00 Ibarra paid for the pup.


The lawsuit, which alleges fraud, breach of warranty and multiple counts of violating the Florida Deceptive and Unfair Trade Practices Act, asks that the plaintiffs be reimbursed for the purchase price of their puppies as well as the veterinary expenses incurred as a result of the purchase an unhealthy pup.


NOTE: Some of the victims of Wizard of Claws and other animal lovers will be demonstrating outside the store at 9101Taft Street, Pembroke Pines tommorow, Saturday, December 13th starting at 11:00 am. Attorneys Mi Kim and Marcy LaHart will be present to answer any questions concerning the case.

Thank you for posting this Anuraagii and welcome to the board :).

Unfortunately, this happens all to often around the country. Pet stores get their animals from puppy mills and class B dealers. All pet stores need to stop selling dogs and cats period, and put the puppy mills out of business for good. People can purchase pets directly from a reputable breeder or adopt from the shelters, humane societies and rescues. Thank you again for sharing this. Its so sad for these animals :(

I had never heard of "Wizard of Claws" before but thanks for posting the article. I just checked out their website and it makes me absolutely sick. My heart goes out to every single one of those puppies and their parents.

See around here we have independent breeders but our pet stores don't sell dogs and the cats that visit the stores are that from the humane society, Biggest thing you can get at our pet stores are rabbits.

That's great- except for the rabbits, that is! Here most pet stores don't sell dogs or cats except for shelter kitties either. There is at least one pet store though that's alway advertising their "cute, adorable, tiny puppies" on the radio, which makes me sick as well when I see pictures of puppies and adult dogs in the area needing homes every week.

Well the pet store that I go to breeds its own guinea pigs and I think they do their own gerbils and hampsters. So they obviously breed in moderation

Give me a break here. There are over a million hits when you search in Google for dog forums and message boards. Perhaps you'd like to help crosspost the press release so everyone else can get it in a more timely fashion.

The purpose of the release is to notify the media and the public this is happening AND just maybe more people will come foreward that have been taken and added to the complaint.

Boy are you guys being taken. The original complaint filed here and the supposed lawsuit originates with a woman who is one angry lady. The lawsuit was thrown out of court and every agency in Florida and in Broward County has inspected the place. All the inspecting agencies have reprted that Wizard of Claws has a first rate facility and there is no evidence of animal abuse.

This lady has gotten a lot of people to jump on her band wagon but she is now facing a 4.2 million dollar slander suit. Most of the information she has published on the web is outright lies. Of course there have been some sick puppies. In many cases it is because people have not properly cared for the puppies. But the Florida Dept of Consumer Affairs says that Wizard of Claws does not have any outstanding complaints and those in the past were resolved to the customer's satisfaction.

I have bought two puppies and a cat from Wizard of Claws.

Can you provide the names of the agencies that inspected Wizard of Claws? I'm assuming you spoke with them first hand.
Also, I'd like the name of the person you spoke to at the Florida Department of Consumer Affairs. I'd like to verify they don't have any complaints and how the old ones were resolved.

You're right about one thing. It did take one person to step up.
It's great your dogs and cat are healthy and you've had a good experience
I would have been better for you to state your experience rather than mis-representing the status of the law suit.

Anuraagii seems to have made his case in point. Going to the sites provided there are 53 (as I count) complaints against Wizard Of Claws, and only 26 of those have been resolved. I would add here that no one should ever buy a dog from a pet store anyway. Period. I am also wondering why after 7 months DaisyJRT you happened to come back to just post to this thread? Also dancerglennn...why would this be your first and only post rather than introducing yourself? Are you following Anuraagii around? Just curious? he seems to have good references and valid sites to check out. How about you two? Can you disprove what he is saying?

Yeah and the case is about fraud...selling puppy's that are reportedly from reputable South American breeders! Trouble with health and other issues always arise from people buying pups without meeting, interviewing, and getting references about the breeder. My point is, no matter what, even if they had been from South America, the people that bought a pup from Wizard Of Claws were naive and ignorant about puppy mills and BYBs anyway. Hopefully it will shut the place down regardless. I agree that pet stores should not be allowed to sell cats and dogs. Actually they need to get out of the pet selling business period and stick to supplies. They make it too easy for an impulse buyer to see something cute and just wander in without thinking and buy a pet they later dump. JMHO

All you have to do is go to Rip-Off Report.com Badbusinessbureau.com & you will find 15 PAGES of complaints. I too bought a sick dog from them & they sold me a toy pug that was to be no more then 8 pounds, at 11 months she is 17 pounds. She had worms FALLING out of her rectum & had kennel cough. I think you were just lucky!
